OMG!

If I were the person in charge of responding back to the State of Texas unemployment request, and I missed a deadline on the city manager that was fired in February, and because of my incompetence the EX city manager started receiving unemployment benefits .....I would resign in shame and move to another town!

There are NO FREAKING EXCUSES!

This man should be shamed at every corner he's seen at.  He shouldn't be served in this town anywhere that has the right to refuse service!

Geez, if I were the same man that for years couldn't see any problems at JB Wells,  if I were same man that did NOT put in ANY checks and balances for money handling and then is baffled how we are short on cash, if I were the same man that was suppose to separate JB Wells into its own fund 6 months ago, if I were the man that had not taken action on any one of the limited notes made by our auditors, if I were the man that pulled %$@#( numbers out of thin air for our budget instead of real numbers, if I were the man that never came to the city council letting them know how bad the financials were, EVEN though it was my job I would dig a hole and crawl into it after I quit in shame. In Japan I would be expected to commit Hari-kari.

HOW MUCH LONGER IS THIS TOWN GOING TO STAND FOR THIS KIND OF INCOMPETENCE?????  There is ABSOLUTELY no reason that a certain financial officer should have his job after close of business Monday.

Call the city on Monday, 672-2815, let them know this is unacceptable that we are still paying any kind of salary to our EX city manager and that those responsible should be shown the door IMMEDIATELY!!!

I swear, it appears the 2 were working in cahoots.  You have to wonder how much covering up he might of done to protect his EX boss.

This is the end of this public ranting.

God Bless,
Dennis Nesser

  1. Dennis, does anything surprise you concerning Gonzales? Nothing surprises me any more. But you know, the mayor is the captain of this sinking ship, and he now has full support of everyone in the city administration.
Forgot an unemployment response huh? Is that as bad as forgetting to renew the city electrical contract with LCRA? I think not.
I am embarassed to say I live in Gonzales. I wish they would de-annex my home. I would go ahead and pay the taxes if they would.

  2. Dennis,
    1. How did you find out about this?
    2. If it is true, was the CFO given instructions by "someone" to do this?
    3. I agree, and have told our city council reps several times that he should be gone.
    4. What is going on with the investigation of the funds theft at the J B Wells and other city facilities?
    5. When do the Texas Rangers start their investigation? The hell with the DA. That office needs to be investigated also.

  3. I will be requesting from the City, through the Freedom of Information Act, all correspondence from the Texas Workforce Commission & the City of Gonzales regarding Huseman. My quickest solution to this would be for the City of Gonzales to call the Texas Workforce Commission and offer David Huseman a JOB! If he refuses, that will end his benefits. I believe there is a need for the deep cleaning of the concession stands & surely the horse stalls need cleaning after they sheltered animals due to the fires. I'm sure the City of Gonzales could correct their "deadline omission" by offering to rehire him for a position in maintenance, after all there is a need. Where there is a will, there is a way. How precarious the City response to the unemployment claim deadline was overlooked!

  4. For the 2nd comment
    1) I was told, and confirmed this with a second source at the city.
    2) It is this persons job to answer ALL of these request, not just Mr. Husemans. Just sweet that he "happened" to miss this one of all of them.
    3) Agreed
    4) The Texas Rangers picked up the paperwork and information a couple of weeks ago (the Friday before we hired a new city manager).
    5) See above, and I agree, the DA needs investigation too.

Pam - You can try, but because of the HR nature you might not be able to get far. Even I had problems getting someone to 'nod twice for yes' to give me an answer to confirm this before I posted it.

Btw, we've already PAID for the cleaning out at JB Wells...I've got more on that coming, but I've got my FOI request in and am awaiting the response.

  5. I wish you well Dennis and Pam, but knowing that the Texas Employment Commission is employer friendly a simple protest of benefits would be no problem with TEC. And knowing that Mr. Huseman was fired for "not communicating with the council" I don't think the protest will be upheld. Mr. Huseman was not fired for cause, he was fired on a whim by the council. I'm not agreeing he should be provided the benefits, just legally he is entitled.

  6. Bill you are absolutely incorrect. Mr. Huseman was fired for not at any whim, but for not doing his job, not working with the council, not following directions.

But more importantly the fact that we did NOT respond to a TWC claim is nothing shy of neglect of duty. If we had filed and lost we at least had an appeal process before us, now we have nothing.

  7. Dennis, I was there when they fired him. The ONLY reason given and that was by Mr. Hernandez, was that he didn't communicate with the council. No other reason was given.
But I know, you know it all so have it your way.

  8. Any business has a right to protest an unemployment claim.

That doesn't mean that it will succeed in protesting it.

However, there is a specific timeline to file that protest. And if it is missed, you have no recourse.

The fact that the CFO missed this one brings up several questions.:
    1. Has he missed others and caused the City to have a higher unemployment tax rate than it should, which means that the city and us property owners have to pay more taxes becasue of it?
    2. Or is this the only one he missed?
    3. If this was the only one he missed, was he given instructions to do so?

And in light of all the mismanagement that has surfaced under Mr. Huseman's reign, and maybe other city managers, it seems that they made the right decision in terminating him. Due to confidentiality of personnel information, maybe they can't disclose all they knew at that time.

  9. Bill - I'll take that as a compliment coming from the one man in this city that knows more than me.

I have written in this blog on more than one occasion why Mr. Husmeman was fired, and communications was only one of the reasons. Others could not be brought up in public, hence the request of the council to take the issue into executive session. That was Mr. Husemans desire to leave it in public ---I was at that very same meeting too.

Whomever the last response is, that is my point exactly. As long as we respond in a timely manner we at least have the opportunity to respond and appeal. The second you miss a deadline it's all over. No recourse.

It leads to to many questions on the operations, and our unemployment rate, or if he has made every other on time then why this one of all of them to miss?

  10. Wow Dennis, I'm glad you finally realized it.
Dennis, I worked in labor relations for almost 37 years, I do know how TEC works.

    http://www.twc.state.tx.us/news/efte/final_pay_severance_benefits.html

He received 6 months of severance pay from his employment contract. Did he report this severance pay on his initial unemployment claim? I believe his initial benefits would have been postponed by this 6 months if he had. According to our current CM, his initial claim is either exhausted or about to be. Followt the 2 links provided above and you do the math!

31 years myself, Bill. I know how TEC works too.

  12. By the way, all you long-time former employees of Texas Workforce Commission, it is "TWC" and has been for years.

    ReplyDelete
  13. Mr. Anonymous...I NEVER, EVER said I was a former employee of TEC! My Daddy tought me to earn a living, not to shame the family by taking a state welfare job. I just had to deal with TEC in my real job.
Other Mr. Anonymous: Are you saying Mr. Barnes is giving out information on a former employee?

  14. Bill,

Indeed he did, via e-mail. Ask and you shall receive. I have no idea if it is factual, but I did receive a prompt reply.

I typically never act like this, but to whoever posted the crack about TWC/TEC-blow it out your ear or at least post something of substance.

Sorry for the offense. I was just trying to just point out that those quoting TEC experience wasn't that all correct.

Yeah, I probably should have dropped the thought.

I do think we need to give our new administration time to get things "fixed". It didn't get that way over night. It won't be "fixed" over night. They need to listen to sugestions from the public, especially those that reveal major problems.

Yes, TEC is now TWC, but even old time TEC employees still call it TEC.

Absolutely correct! But the problem is there is only one new guy that might listen to the citizens, and that is to be found out in the future if he will. The others have proven they can't hear or choose to ignore the citizens.
The others have fallen right in with the spend, spend, spend, even though they claimed to be "fiscal conservatives".

  17. It is a very discouraging situation. My councilman is utterly worthless and most certainly has his own agenda and not that of the majority in his district. Short of a major uprising of the citizens, which I'm all for, I don't see any hope of change until election time again, and even then, it's a gamble, but that's no reason not to stay involved with your local government. Apathy is why we're where we are now. As far as "can't hear or choose to ignore," that couldn't be more true. My councilman refuses to respond electronically. I guess he doesn't like the idea of a paper trail.

  19. This town is getting pretty scary -- reading all these articles about our current city's administration and the troubles they are having now that Mr. Huseman is gone. All kinds of things have come to light.

You would be shock to listen to what ppl are saying about how back door deals have been going on for a long time. Its just now coming out to everyone instead of a select few.

The firing of Mr. Huseman started a house of cards to fall. Now its up to the new city manager to fix the issues we are having in this town. Good Luck to Him.

Hopefully we can all move on from this year. It has been an interesting one. Looking forward to next year with new hope for growth in the downtown area.

  20. The problem is that some of us have been hearing those rumors, and seeing the results for a long time. Others either buried their head in the sand, or just didn't want to believe it.

When Huseman most wanted to keep him. But the council saw the whole picture and did what's right. Now they are paying the price of trying to please the voters and keeping him around so long. I hope when elections come around that the voters remember who voted to keep Mr. Huseman and who voted to get rid of him.

But I want to point out, some of this goes well before Mr. Huseman, and well before most of these guys were on the council. Not a pass to anyone, but this didn't happen over night.

  21. LOL Dennis, I hope the sun comes up in the morning. I agree with your last statement 100%. When I moved here in the 1980's the voter fraud concerning absentee ballots was going on then. I'm told by life long residents that there is nothing new going on, just some are getting dumber or more brazen about it. The voters could change it, but I'm betting nothing changes. I just wish we could elect people that are what they say, and do what they say.

  23. Well, Anonymous, it's more fun to complain. And when those that are SCARED to post their names say I should move, that means I got you! LOL

  24. "silent majority" That is the problem in Gonzales. The majority of the citizens stay silent. Look what happened when a few spoke loudly to HEB. Three years ago no one, and I mean no one would speak out. Then a few let HEB know how the people felt about their disservice to Gonzales. It got their attention and now a new modern store is under construction. Look what happened when a reporter started speaking loudly, so loud it cost her her job. More joined in with her and two local thieves were taken out of positions dealing with taxpayer money. More need to be removed, but as usual, the "silent majority" remain quite so nothing is done.
So, stay silent and let the City of Gonzales rot within itself, or speak out and allow the city to become a "Shining Star" in Texas. Let it be something to be proud of instead of the butt of jokes.
